Cancellation Policy and Termination – Pawana Estates (Lonavala, near Pawana Lake) VISIT PAGE 

 

This clause applies to all agreements entered into by Pawana Estates for villa renovation, villa restoration, new bungalow construction, and plot‑listing / brokerage services in Lonavala, near Pawana Lake. VISIT OUR PAGE 

  1. Advance Payment and Project Value
    • The Client shall pay an advance of 10% to 20% of the total project value at the time of booking, as mutually agreed.

    • The remaining payments shall be made in stages as per the work progress schedule attached to the agreement.

  2. Mode of Cancellation
    • Any cancellation of this agreement by the Client must be made in writing (email or registered letter) and addressed to Pawana Estates.

    • The cancellation shall be effective only upon written acknowledgment by Pawana Estates.

  3. Cancellation before commencement of work
    • If the Client cancels within 7 days of payment of the advance, Pawana Estates shall refund 95% of the advance amount, deducting 5% as administrative and processing charges.

    • If the Client cancels after 7 days but before any physical work, material orders, or major commitments are initiated, the entire advance amount (10–20% of project value) shall be non‑refundable as per the terms of this agreement, unless otherwise mutually agreed in writing.

  4. Cancellation after commencement of work
    • If the Client terminates the agreement after commencement of demolition, construction, renovation, or restoration work, the following shall apply:

      • The Client shall pay for all actual costs incurred by Pawana Estates, including labour, materials, and third‑party approvals.

      • The value of work completed shall be certified by Pawana Estates (with supporting documents) and shall be treated as paid‑in from the Client.

      • project‑closure / administrative fee of up to 10% of the value of work completed shall be payable, subject to mutual agreement.

    • The remaining balance (if any) shall be refunded to the Client within 30 working days from the date of closure of the project.

  5. Plot‑listing and brokerage services
    • For plot‑listing and brokerage services for plots near Pawana Lake:

      • If the Client cancels before registration or execution of the sale agreement, Pawana Estates may retain a reasonable brokerage / processing fee (agreed as a percentage of the plot value or as a fixed amount) for services such as site visits, documentation, and coordination.

      • If the Client cancels after registration or execution of the sale agreementno refund of brokerage or legal‑related fees shall be provided, as the services shall be deemed fully rendered.

  6. Force Majeure
    • In the event of force majeure (including but not limited to natural disasters, pandemics, government orders, or other unforeseeable events), Pawana Estates may suspend or terminate the project after giving reasonable written notice to the Client.

    • In such cases, the Client shall be liable only for actual costs incurred by Pawana Estates up to the date of termination, and any excess payment shall be refunded within 30 working days.

  7. Governing Law and Dispute Resolution
    • This clause shall be governed by the laws of India, and any disputes arising from cancellation or termination shall be subject to the jurisdiction of the courts in Pune / Maharashtra, as mutually agreed.
